Affidavit: Juvenile Intake Officer

For the Week 2 Assignment, you are to assume the role of a juvenile intake officer in your region who is on call after juvenile court closes for the day. Officer Good Guy calls you at 1:30 a.m. on Saturday after apprehending a 15-year-old juvenile who is suspected of arm robbery. The offender did not have a weapon nor items taken from the victim; the victim cannot positively identify the suspect. Case Facts:  911 call at 1:30 a.m. Officer Good Guy responded to the call. Juvenile Intake Officer on duty Address of incident, 9874 At Home Drive, your city Case number #04062019 Juveniles name withheld, referred to in report as Juvenile #1 Address of juvenile and guardian, 1245 Moveover Court, your city Police Report shows: Three prior contacts with police; misdemeanor trespassing, driving without a license, out past curfew Current Charges on Offender: Out past curfew (juveniles under the age of 17 must be off the streets from 10 p.m. to 6 a.m.) Unlicensed driver (does not have a permit) Criminal trespass (in parking lot of business that is closed) Possession of motor vehicle without permission (took grandmother’s car without her permission) You are authorized to detain or release all juveniles who are alleged to have committed a crime. If you choose to detain, the juvenile is transported to the nearest detention center. Please use the Juvenile Referral Template for reference. If you allow the juvenile to go home with his or her parents, he or she is released to their parent’s custody with a summons for court. Please use the Summons Template for reference. Tips: Check your local Sheriff’s Department for the legal aspects of the following. Curfew hours for juveniles, if applicable Legal age for a licensed driver Code violation for being at a business after closing hours Your Assignment As the intake officer, the decision to detain or release is entirely up to you. The affidavit will be forwarded to a judge. Complete the Affidavit with the following questions addressed in the narrative. You may used as much space in the template as needed. 1. In the narrative, address the following case fact questions. Who is to be detained? Where was the suspect arrested (complete address)? How was the officer notified? Were there witnesses to the incident? Was the suspect injured during the arrest? 2. Victim information questions: What is the victim’s name and address? Are the victims minors or adults? If minor, were parents notified? Was victim injured during the incident? 3. What criteria would you apply, according to the statutes, and policies and procedures in your region to make the decision to detain or release? 4. Would you incorporate the local sanctions for this alleged felony act in your area? 5. How would you determine if there is enough evidence to detain the juvenile? Defend your position.
