After reviewing the information posted about the Duke case, answer the following questions: 1. What could have been done to prevent this travesty of justice?   2. What should have happened to the District Attorney in this case? Was the conviction, sentence and resulting professional repercussions enough to punish this behavior?   3. Who should be responsible civilly to the men who were wrongfully prosecuted in this case, and what should the compensation be?  In answering this question, I don’t want you to research other jury awards (because if you were on a jury, you would not be able to research other awards).  I want to know, as lay people, what your personal opinion is regarding the amount of a monetary award that you think would be suitable.  Consider what they should be compensated for (pain and suffering, mental anguish, loss of time in school, harm to their reputations, etc.).  There are many things that can be part of a compensation award from a court, and these men suffered greatly as a result of the actions, and inactions, of many.    After reviewing the lecture material on Seeking the Death Penalty, answer the following questions: 4. In making the decision on whether or not to seek death, District Attorneys can do whatever they want.  They have the sole responsibility for making the decision.  There are no rules or requirements, and no formula they must follow.  Should there be some kind of analysis that is done or formula that is followed to ensure that only the “worst of the worst” are executed, or should prosecutors have discretion to seek death against defendants who are eligible without any consultation with or input from others?     5. Many D.A.’s don’t personally support the death penalty.  However, they have an obligation to weigh it as an option.  In the end, in states that have the death penalty as an option, should it be a requirement that people who run for the position agree they could seek death, even if they are opposed to it on moral and/or religious grounds?
