Hodges, 576 U.S. _____ (2015) Loving v. Virginia, 388 U.S. 1 (1967) Lawrence v. Texas, 539 U.S. 558 (2003) Griswold v. Connecticut, 381 U.S. 479 (1965) Mandatory Open Universe Cases: Find two additional cases from either the US Supreme Court of a U.S. Circuit Court of Appeals that connect the above-listed cases with the argument you make to support you position for the question presented below. Mandatory Secondary Sources: You must use two scholarly secondary sources to their help analyze the historical basis of this issue or to support your contention on the question presented. Question Presented: The aforementioned cases inter alia state that there is a fundamental right to liberty and privacy as elucidated by the 4th, 5th, 9th, and 14th Amendments. To what extent do these freedoms extend to LGBT individuals? Keep a keen focus on the primary issue here: do transgender individuals have a Constitutional right to use the bathroom of the gender not listed on their birth certificate in places of “public accommodation”? Or conversely, does the state have the right to compel transgender individuals to use the bathroom as it is listed on their birth certificate, despite their status otherwise?
